Get Your Employer Identification Number — Step by Step
Once your LLC has been officially approved by the state, you’re ready for the next important step: getting your Employer Identification Number (EIN).
An EIN is a 9-digit federal tax identification number assigned by the IRS. It is used for business tax and reporting purposes and may also be requested when opening business bank accounts or setting up other business-related accounts.
⚠️ DO NOT APPLY BEFORE YOUR LLC IS APPROVED
If you are forming an LLC, the IRS recommends that you form your legal entity with your state first, then apply for the EIN.
Applying before the LLC is officially formed can cause delays or create problems matching the EIN information to your business entity.
So before continuing, make sure:
☐ Your LLC has been approved
☐ You have received your LLC formation documents
☐ You know your exact legal LLC name
☐ You have your business address available
☐ You know who the responsible party will be
🆔 WHAT IS A RESPONSIBLE PARTY?
When you apply for your EIN, the IRS will ask for the responsible party.
The responsible party is generally the individual who ultimately owns or controls the business and manages its funds or assets.
For most one-member LLCs, this will usually be you, the owner.
The IRS requires the responsible party to be an actual person rather than another business entity, except in certain government situations.
You will need the responsible party’s taxpayer identification number, such as an SSN or ITIN.
💻 APPLY DIRECTLY THROUGH THE IRS
The EIN application itself is FREE.
Do not pay a third-party website just to obtain an EIN unless you intentionally want to hire someone to complete the application for you.
The IRS provides an online EIN application for eligible applicants located in the United States or U.S. territories.
Before You Start
Have the following information nearby:
✓ Your exact LLC legal name
✓ The date your LLC was formed
✓ Your business mailing address
✓ Your physical business address, if different
✓ Your name and SSN/ITIN as the responsible party
✓ The reason you're applying for the EIN
✓ Information about your business activity
✓ Whether you expect to have employees
🖥️ START THE EIN APPLICATION
Go to the official IRS EIN application.
Look for:
Apply for an Employer Identification Number (EIN)
Then select the option to begin the application.
⚠️ Mrs. Gwen's Tip: Make sure you're on the official IRS website. There are many websites that look like EIN application sites but charge fees for something the IRS provides for free.
📄 SELECT YOUR BUSINESS ENTITY TYPE
When asked what type of legal structure you're applying for, select:
Limited Liability Company (LLC)
The application will ask additional questions about your LLC.
Read each question carefully.
If you formed a one-member LLC, make sure your answers reflect your actual business structure.
Do not guess if you're unsure about a tax-classification question. The legal structure of an LLC and the way an LLC is taxed are not necessarily the same thing.
👤 ENTER THE RESPONSIBLE PARTY
Enter the information requested for the person who owns or controls the business.
For a one-member LLC, this will commonly be the owner.
Enter your information exactly as requested.
Be sure that names and identifying information are entered correctly before proceeding.
🏢 ENTER YOUR LLC INFORMATION
Use the exact legal business name shown on your approved LLC formation documents.
Do not shorten it or change the spelling.
For example:
If your formation paperwork says:
Jones Spot LLC
do not enter:
Jones Spot
or
Jones Spot Company
The IRS information should match your legal entity information as closely as possible.
📍 ENTER YOUR BUSINESS ADDRESS
Enter the business address requested by the IRS.
Read carefully to determine whether the application is asking for:
• Physical business address
• Mailing address
• Responsible party address
Do not automatically assume every address field is asking for the same thing.
📅 ENTER YOUR LLC FORMATION INFORMATION
When asked when your LLC was formed, use the date shown on your approved state formation documents.
Keep those documents nearby while completing the application so you don't have to rely on memory.
💼 REASON FOR APPLYING
The IRS application may ask why you need an EIN.
Choose the answer that truthfully applies to your business.
For a newly formed LLC, the appropriate choice may relate to starting a new business, depending on the options presented.
Read each selection before choosing.
🛍️ DESCRIBE YOUR BUSINESS ACTIVITY
The IRS may ask what your business does.
Choose the category that most closely describes your primary business activity and answer any follow-up questions.
If your LLC may eventually operate several different activities, answer based on what your business is primarily doing now.
👥 EMPLOYEE QUESTIONS
You may be asked whether you expect to hire employees.
Answer honestly based on your actual plans.
Do not say that you will have employees simply because you think it will help your application.
✅ REVIEW EVERYTHING BEFORE SUBMITTING
Before submitting your EIN application, stop and review:
☐ LLC legal name
☐ Responsible party name
☐ SSN/ITIN
☐ Business address
☐ Formation date
☐ Business activity
☐ Employee information
☐ All spelling and numbers

Read it twice before you submit it once.
Mistakes can sometimes be corrected later, but it's much easier to get the information right the first time.
🎉 ONCE YOUR EIN IS ISSUED
If the online application is successfully completed, the IRS says eligible applicants can receive the EIN online and use it immediately.
The IRS will also provide an EIN assignment notice.
SAVE THIS DOCUMENT.
Download and save it immediately.

You may need your EIN information later for business banking, tax filings, vendor accounts, payroll, and other business activities.

✓ Store it with your LLC formation documents
Do not depend on being able to download the document again later.
🚨 WHAT IF THE ONLINE APPLICATION DOESN'T WORK?
If the IRS online application gives you an error or tells you that you cannot complete the application electronically:
DON'T PANIC.
First, carefully read the error message.
You may need to use Form SS-4 instead.
For U.S.-based applicants, the IRS currently allows Form SS-4 to be submitted by:

The IRS says faxed applications may receive an EIN response in about 4 business days, while mailed applications may take approximately 4 weeks.
☎️ About Calling the IRS
For ordinary U.S.-based EIN applications, the IRS does not currently list telephone application as the standard method. Telephone EIN applications are generally available to international applicants whose principal place of business is outside the United States or U.S. territories.
If you're having trouble with your application, you can still contact the IRS for assistance, but don't assume that calling is the required filing method.
⚠️ IMPORTANT: ONLY APPLY ONCE
The IRS limits applicants to one EIN per responsible party per day and advises using only one application method for the same entity so you don't accidentally receive multiple EINs.
So don't submit an online application, fax an SS-4, and mail another one at the same time.
